Variable is null but the report show random data

Hi,
i have a Variable that show the data in a report ,this Variable store data from a CheckedListBoxControl but when i don't check any record in that CheckedListBoxControl the Variable should be null ,infact it is null but when i compile, the report show the data , instead if i check some Items in CheckedListBoxControl the Variable is not null and compiling the Report show the right data,that's happen suddendly without i changed any code in my report .

I don't understand how i can correct this step ,do you have any idea what it could be?
